1. Who We Are
Kismet Jewels NYC (“we”, “us”, “our”) is a trade fine jewellery manufacturing studio based in New York City’s Diamond District. We provide custom jewellery design, CAD modelling, 3D prototyping, casting, stone setting and finishing. Our studio is located at 37 W 47th St, New York, NY. 2. Services
We offer trade jewellery creation: from initial briefing and design through to finished goods. Our services include CAD jewellery design, 3D prototyping, casting in gold, platinum and silver, diamond and gemstone supply, stone setting and final finishing. We also offer repairs, resizing and maintenance. The exact scope of work for your project will be set out in our written quote or order confirmation.
3. Trade briefings
Design briefings (in person at our NYC studio or by video/phone) are complimentary and non-binding. We use them to understand your line intent, budget and timeline. No obligation to proceed arises from a briefing. We aim to respond to enquiries within 24 hours; response times may vary.
4. Quotes, Orders and Acceptance
Quotes are valid for the period stated on the quote (typically 14–30 days) and are subject to availability of materials and capacity. An order is formed only when you accept our quote in writing (e.g. by email) and, where we require it, pay a deposit. We may decline any order at our discretion. Custom designs are unique to you; we do not replicate trade orders for third parties without your consent.
5. Payment
Payment terms will be agreed per project. Typically we require a deposit (often 50%) to begin production, with the balance due before or upon delivery. We accept payment by methods we specify (e.g. bank transfer, card). You are responsible for any bank or card fees. Prices are in US dollars unless otherwise stated and exclude applicable sales tax; you are responsible for any tax we are required to collect.
6. Delivery and Collection
We will agree delivery or collection with you. Finished pieces can be collected from our NYC studio by appointment or shipped securely. Delivery times are estimates; we are not liable for delays due to circumstances beyond our control (e.g. supply chain, customs, carrier delay). Risk of loss or damage passes to you on handover to the carrier or on collection. We recommend insured shipping for high-value items.
7. Timelines
We will give you an estimated timeline (e.g. 2–5 weeks from approved design). Timelines may change due to complexity, stone sourcing or other factors. We will keep you informed. Rush orders may be possible for an additional fee and subject to capacity.
8. Design Approval and Revisions
You approve designs (CAD, prototype or both) before we move to casting. One round of design revisions is typically included; further revisions may incur a fee. Once you have approved the design and we have started production, changes may not be possible or may result in extra cost and delay. It is your responsibility to confirm that approved designs meet your expectations.
9. Warranties
We stand behind our craftsmanship. If a piece has a manufacturing defect (e.g. a stone becomes loose due to a setting fault, or a clasp fails under normal use), we will repair it at no charge within a reasonable period (typically one year from delivery), subject to the piece not having been altered, damaged or repaired by a third party. This does not cover normal wear, accidental damage, or issues arising from misuse. Natural materials (e.g. pearls, some gemstones) may have inherent characteristics that are not defects. Our warranty is in addition to any statutory rights you may have.
10. Refunds and Cancellation
Trade jewellery is made to your order. Once production has started (e.g. after casting has been carried out), orders cannot normally be cancelled and deposits are non-refundable. If you cancel before production has started, we may refund the deposit in whole or in part at our discretion, minus any costs already incurred (e.g. design work, stone sourcing). If we cancel an order (e.g. due to force majeure), we will refund any amount you have paid. We do not offer refunds on completed pieces unless they do not conform to the agreed design or are defective; in such cases we will first offer repair or replacement where appropriate.
11. Care and Maintenance
Your piece should be cared for as set out in the care instructions we provide and in our Care Guide. We recommend periodic check-ups (e.g. once a year) for pieces worn daily. Damage or loss due to failure to follow care advice or to have recommended maintenance may affect any warranty or repair policy.
12. Limitation of Liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or in connection with our services or these terms shall not exceed the amount you paid us for the relevant piece or service. We are not liable for indirect, consequential or punitive damages (e.g. loss of profit, loss of use, emotional distress). Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
13. Intellectual Property
Designs and deliverables we create under your commission are for your agreed commercial use (for example resale under your brand or supply to your clients) as set out in your order or statement of work. We retain ownership of our underlying CAD libraries, processes and know-how unless otherwise agreed in writing. You may not use our name, logo or imagery in ways that imply endorsement or partnership without our written consent. We may use anonymised images of finished pieces for our portfolio and marketing unless you ask us not to.
14. Privacy
Your use of our website and services is also governed by our Privacy Policy. By using our services you consent to the collection and use of your information as described there.
15. Disputes and Governing Law
These terms are governed by the laws of the State of New York, USA, without regard to conflict of law principles. Any dispute arising out of or relating to these terms or our services shall be resolved in the state or federal courts located in New York County, New York, and you consent to the exclusive jurisdiction of those courts. We encourage you to contact us first to resolve any concern; we will do our best to address it in good faith.
16. Changes to These Terms
We may update these terms from time to time. The current version will always be published on this page with an effective or “last updated” date. Continued use of our services after changes constitutes acceptance of the revised terms. For existing orders, the terms in effect at the time of your order apply to that order unless we agree otherwise.
17. Severability
If any provision of these terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
