1. Information We Collect
We collect information you give us directly and information we get from your use of our site and services.
Information You Provide
When you contact us via the website form, email or phone, we may collect your name, email address, phone number, and the content of your message. If you provide it, we may also collect your company or brand name, mailing address, and details about your project (e.g. type of piece, budget range, timeline). When you place an order we collect information needed to fulfil it: contact details, delivery address, payment-related information (e.g. billing address) and any preferences you specify (e.g. stone certificates, care instructions). We do not store full credit card numbers on our servers; payment processing is handled by secure third-party providers.
Information Collected Automatically
When you visit our website we may collect certain technical data, such as your IP address, browser type, device type, and pages visited. We may use cookies and similar technologies as described in the Cookies section below. This helps us improve the site and understand how visitors use it.
2. How We Use Your Information
We use your information only for legitimate business purposes:
- To respond to enquiries, answering questions, providing quotes and scheduling trade briefings.
- To provide our services, designing, manufacturing and delivering your trade jewellery; communicating about your order and timeline.
- To process payments, taking deposits and final payment in line with our Terms of Service.
- To send service-related communications, order confirmations, delivery updates, care instructions and (with your consent) occasional news or offers.
- To improve our website and services, analysing usage and feedback so we can offer a better experience.
- To comply with legal obligations, for example tax, anti-money laundering or other regulations that apply to our business.
We do not sell your personal data to third parties. We do not use your information for automated decision-making or profiling that has legal or similarly significant effects.
3. Legal Basis (If You Are in the EEA/UK)
If you are in the European Economic Area or the United Kingdom, we process your data on the basis of: (a) your consent, where we ask for it (e.g. marketing); (b) performance of a contract (e.g. fulfilling your order); (c) our legitimate interests (e.g. responding to enquiries, improving our services, security), where those interests are not overridden by your rights; and (d) compliance with legal obligations.
4. Data Retention
We keep your information only as long as necessary for the purposes above. Enquiry data may be retained for a reasonable period (e.g. 2–3 years) so we can follow up or refer back to past projects. Order and client records are retained for longer to satisfy legal, tax and warranty obligations (typically at least 7 years where required by law). After that we delete or anonymise data where possible. You can ask us to delete your data earlier where we are not legally required to keep it; see Your Rights below.
5. Sharing and Third Parties
We may share your information with:
- Service providers, e.g. email hosting, form handlers (such as Formspree), payment processors, and (if we use them) shipping or cloud storage providers. They process data on our instructions and are bound by confidentiality and data protection obligations.
- Professional advisers, lawyers, accountants or insurers where necessary for our business.
- Authorities, when required by law or to protect our rights, safety or property.
We do not share your data with third parties for their own marketing. If you use a third-party link from our site (e.g. social media, mapping), their own privacy policies apply.
6. International Transfers
We are based in the United States. If you are outside the US, your information may be transferred to and processed in the US or other countries where our service providers operate. Those countries may have different data protection laws. Where we transfer data from the EEA or UK we rely on appropriate safeguards (e.g. standard contractual clauses or adequacy decisions) as required by applicable law.
7. Cookies and Similar Technologies
Our website may use cookies and similar technologies (e.g. local storage) to remember preferences, understand how the site is used and improve performance. Essential cookies are necessary for the site to function (e.g. security, load balancing). Analytics or functional cookies may be used to see how visitors navigate the site; we do not use advertising or tracking cookies for third-party ads. You can control cookies through your browser settings; blocking certain cookies may affect site functionality. We do not currently use a cookie banner; if we introduce non-essential cookies we will update this policy and obtain consent where required by law.
8. Security
We take reasonable technical and organisational measures to protect your personal information against unauthorised access, loss, alteration or misuse. This includes secure transmission (e.g. HTTPS), limited access to data and secure storage. No method of transmission or storage is 100% secure; we cannot guarantee absolute security. If you have reason to believe your interaction with us is no longer secure, please notify us at Shivam@Kismetjewelsnyc.com.
